Stat. § 590.01, subd. 4(a) (2012) had expired, and neither the newly discovered evidence nor the interests of justice exceptions to the limitations period apply.
Affirmed. Justice David R. Stras.

Green v. BMW of N. Am., LLC Docket: A11-581 Opinion Date: February 13, 2013 Judge: Gildea Areas of Law: Consumer Law, Contracts Plaintiff leased a vehicle from BMW. Plaintiff claimed the leased vehicle was defective and brought suit against BMW. After a bench trial, the trial court awarded Plaintiff $25,157 in damages based on Minnesota's lemon law. The district court then granted Plaintiff's motion for an award of attorney fees and litigation costs, awarding Plaintiff a total of $229,064 in fees and costs. In reaching its conclusion on attorney fees, the court determined that it was "improper to compare the amount of reasonable legal fees to the amount of recovery in determining the proper fee award." The court of appeals affirmed. The Supreme Court reversed, holding (1) the amount involved in the litigation and the results obtained are relevant factors that the district court is to consider in awarding attorney fees under Minnesota's lemon law; and (2) the district court abused its discretion by failing to consider these factors in awarding attorney fees under the lemon law. Defendant was sentenced to life imprisonment. The Supreme Court affirmed Defendant's convictions on direct appeal. Defendant filed a petition for habeas corpus relief in federal district court, which was denied, and a petition for postconviction relief in state court, which was also denied. Defendant subsequently filed a second petition for postconviction relief, which the postconviction court denied after concluding that the petition was filed after the expiration of the two-year limitations period in Minn. Stat. 590.01, subd. 4(a)(2). Berkovitz, 52, of St. Paul, was arrested without incident Monday shortly after the fatal shooting of Shelley Joseph-Kordell, 56, of Minnetonka, and the wounding of attorney Richard Hendrickson, 53, of Crystal. Prosecutors charged Berkovitz with one count of first-degree murder and one count of first-degree attempted murder Wednesday in the shooting at the Hennepin County Government Center. Berkovitz was in the county jail in lieu of $2 million bail. Hennepin County Attorney Amy Klobuchar said prosecutors would bring the case before a grand jury within two weeks. Joseph-Kordell died a few hours later from her injuries. Hendrickson was in satisfactory condition Wednesday at Hennepin County Medical Center, with a bullet still lodged in his neck, but family members said he was expected to recover fully. The Smith & Wesson .38-caliber revolver was manufactured sometime between 1890 and 1910, and held five bullets, said Sheriff Patrick McGowan. Justia.com Opinion Summary: Policyholder obtained a title insurance policy from Insurer for a parcel of property it owned. Because an ambiguity in the legal description of the property prevented Policyholder from reselling the property, Policyholder filed an action seeking a declaration of Insurer's obligations under the policy and alleging breach of contract against Insurer. The district court held in favor of Policyholder, concluding that Insurer was liable because the title to the property was unmarketable. The court, however, limited Policyholder's recovery to the face value of the policy. The court of appeals affirmed the finding of liability but held that Policyholder was entitled to recovery in excess of the policy limit. The Supreme Court (1) affirmed the district court's grant of partial summary judgment to Policyholder on the question of Insurer's liability for its failure to defend and indemnify Policyholder; but (2) reversed the court of appeals' award of damages to Policyholder in excess of the policy limit and remanded for reinstatement of the district court's award of damages.
